第1条危险条款(Perils)
1Subjectalwaystotheexclusionshereinafterreferredto,thisinsurancecoverslossofordamagetotheVesselcausedby
1.2warcivilwarrevolutionrebellioninsurrection,orcivilstrifearisingtherefrom,oranyhostileactbyoragainstbbelligerentpower.
1.3Captureseizurearrestrestraintordetainment,andtheconsequencesthereoforanyattemptthereat
1.4Derelictminestorpedoesbombsorotherderelictweaponsofwar
1.5Strikers,locked-outworkmen,orpersonstakingpartinlabourdisturbances,riotsorcivilcommotions
1.6Anyterroristoranypersonactingmaliciouslyorfromapoliticalmotive
1.7Confiscationorexpropriation.
1受此后提及的除外条款的制约，本保险承保下列原因造成的保险船舶的灭失或损害：
1.1战争、内战、革命、叛乱、暴动或由此引起的内乱或任何交战团体之间的敌对行为
1.2捕获、扣押、扣留、管制或拘押以及这些行为引起的后果或进行这些行为的任何威胁企图
1.3被遗弃的水雷、鱼雷、炸弹或其他被遗弃的战争武器
1.4罢工者、闭厂工人或参与劳资纠纷、暴乱或民事骚乱的人员
1.5任何恐怖分子或出于政治动机行为的人员
1.6没收或征用。
第2条并入条款（Incorporation）
2INCORPORATION
TheInstituteTimeClauses-Hulls1/11/95(including3/4thsCollisionLiabilityamendedto4/4ths)exceptClauses1.4,2,3,4,5,6,12,22.1.8,23,24,25,26,and27aredeemedtobeincorporatedinthisinsuranceinsofarastheydonotconflictwiththeprovisionsoftheseclauses.
HeldcoveredincaseofbreachofwarrantyastotowageorsalvageservicesprovidednoticebegiventotheUnderwritersimmediatelyafterreceiptofadvisesandanyadditionalpremiumrequiredbythembeagreed.
2并入
1995年11月1日协会船舶定期保险条款（包括3/4碰撞条款修改为4/4），除了第1.4、2、3、4、5、6、12、22.1.8、23、24、25、26和27条外，就其不与这些条款的规定相冲突而言，均视为被并入本保险。
在违反拖带和救助服务方面的保证时，假如在接到该违反的通知后立即通知了保险人，并同意保险人要求的任何附加保险费，可以续保。
第3条拘押条款（Detainment）
IntheeventthattheVesselshallhavebeenthesubjectofcaptureseizurearrestrestraintdetainmentconfiscationorexpropriation,andtheAssuredshalltherebyhavelostthefreeuseanddisposaloftheVesselforacontinuousperiodof12monthsthenforthepurposeofascertainingwhethertheVesselisaconstructivetotallosstheAssuredshallbedeemedtohavebeendeprivedofthepossessionoftheVesselwithoutanylikelihoodofrecovery.
万一保险船舶已成为捕获、扣押、扣留、管制、拘押、没收或征用的标的，且被保险人因此已失去对保险船舶的自由使用和处分连续12个月，那么，为确定保险船舶是否推定全损之目的，被保险人应视为已被剥夺对保险船舶的占有无恢复占有的任何可能性。
第4条索赔通知和招标条款(NoticeofClaimandTenders)
4NOTICEOFCLAIMANDTENDERS
Intheeventofaccidentwherebylossordamagemayresultinaclaimunderthisinsurance,noticemustbegiventotheUnderwriterspromptlyafterthedateonwhichtheAssured,OwnersorManagersbecomeorshouldhavebecomeawareofthelossordamageandpriortosurveysothatasurveyormaybeappointediftheUnderwriterssodesire.
IfnoticeisnotgiventoUnderwriterswithintwelvemonthsofthatdateunlesstheUnderwritersagreetothecontraryinwriting,theUnderwriterswillbeautomaticallydischargedfromliabilityforanyclaimunderthisinsuranceinrespectoforarisingoutofsuchaccidentorthelossordamage.
4如果发生根据本保险可以索赔的损失或损害的意外事故，须在被保险人、船东或管理人知道或应当知道损失或损害之日后，并在检验前，迅速通知保险人，以便在保险人如此要求时指定检验人。
若未在该日起12个月内通知保险人，除非保险人书面作相反的同意，对与此种意外事故或损失，损害有关的或由其引起的根据本保险的任何索赔，保险人自动解除责任。
第5条除外条款(Exclusions)
5EXCLUSIONS
Thisinsuranceexcludes
5.1lossdamageliabilityorexpensearisingfrom
5.1.1theoutbreakofwar(whethertherebeadeclarationofwarornot)betweenanyofthefollowingcountries:
UnitedKingdom,UnitedStatesofAmerica,France,theRussianFederation,thePeople’sRepublicofChina
5.1.2requisition,eitherfortitleoruse,orpre-emption
5.1.3captureseizurearrestrestraintdetainmentconfiscationorexpropriationbyorundertheorderofthegovernmentoranypublicorlocalauthorityofthecountryinwhichtheVesselisownedorregistered
5.1.4arrestrestraintdetainmentconfiscationorexpropriationunderquarantineregulationsorbyreasonofinfringementofanycustomsortradingregulations
5.1.5theoperationofordinaryjudicialprocess,failuretoprovidesecurityortopayanyfineorpenaltyoranyfinancialcause
5.1.6piracy(butthisexclusionshallnotaffectcoverunderClause1.4),
5.2lossdamageliabilityorexpensedirectlyorindirectlycausedbyorcontributedtobyorarisingfrom
5.2.1ionisingradiationsfromorcontaminationbyradioactivityfromanynuclearfuelorfromanynuclearwasteorfromthecombustionofnuclearfuel
5.2.2theradioactive,toxic,explosiveorotherhazardousorcontaminatingpropertiesofanynuclearinstallation,reactororothernuclearassemblyornuclearcomponentthereof
5.2.3anyweaponofwaremployingatomicornuclearfissionand/orfusionorotherlikereactionorradioactiveforceormatter,
5.3lossdamageliabilityorexpensecoveredbytheInstituteTimeClauses-Hulls1/11/95(including3/4thsCollisionLiabilityClauseamendedto4/4ths)orwhichwouldberecoverablethereunderbutforClause12thereof,
5.4anyclaimforanysumrecoverableunderanyotherinsuranceontheVesselorwhichwouldberecoverableundersuchinsurancebutfortheexistenceofthisinsurance,
5.5anyclaimforexpensesarisingfromdelayexceptsuchexpensesaswouldberecoverableinprincipleinEnglishlawandpracticeundertheYork-AntwerpRules1994.
5除外
本保险不承保
5.1下列原因引起的灭失、损害、责任或费用
5.1.1在下列国家之间爆发战争（无论宣战与否）
英国、美国、法国、俄国、中国
5.1.2征购，无论是为所有权还是使用权，或征用
5.1.3由保险船舶所有国或登记国的政府、公共或地方权力机构或根据其命令实施的捕获、扣押、扣留、管制、拘押、没收或征用。
5.1.4根据检疫法规或由于违反海关或贸易法规引起的扣留、管制、拘押、没收或征用
5.1.5实施普通的司法程序，未提供担保，或未支付罚金或罚款或任何财务原因。
5.1.6海盗（但本项除外不影响根据1.4款承保的风险）
5.2由下列原因直接或间接引起或可归因于或造成的灭失、损害、责任或费用
5.2.1任何核燃料或核废料或从核燃料的燃烧产生的放射性或电离幅射污染。
5.2.2任何核装置、反应堆、或其他核装备或核组件的放射性、有毒、爆炸性或污染物质
5.2.3应用原子、或核裂变和/或聚变或其他类似放射性力量或物质制造成的任何战争武器
5.31995年11月1日协会船舶定期保险条款（包括3/4修改为4/4的碰撞条款）承保的或除了第12条之外，可据此获赔的灭失、损害、责任或费
5.4根据任何其他对保险船舶的保险可获赔偿的或非因本保险的存在便可根据此种保险可获赔偿的任何索赔的金额
5.5迟延引起的费用的索赔，但依英国法律和惯例及1994年《约克.安特卫普规则》原则上可获赔偿的费用除外。
第6条终止条款(Termination)
6TERMINATION
6.1ThisinsurancemaybecancelledbyeithertheUnderwritersortheAssuredgiving7daysnotice(suchcancellationbecomingeffectiveontheexpiryof7daysfrommidnightofthedayonwhichnoticeofcancellationisissuedbyortotheUnderwriters).TheUnderwritersagreehowevertoreinstatethisinsurancesubjecttoagreementbetweentheUnderwritersandtheAssuredpriortotheexpiryofsuchnoticeofcancellationastonewrateofpremiumand/orconditionsand/orwarranties.
6.2WhetherornotsuchnoticeofcancellationhasbeengiventhisinsuranceshallTERMINATEAUTOMATICALLY.
6.2.1upontheoutbreakofwar(whethertherebeadeclarationofwarornot)betweenanyofthefollowingcountries:
UnitedKingdom,UnitedStatesofAmerica,France,theRussianFederation,thePeople’sRepublicofChina
6.2.2intheeventoftheVesselbeingrequisitioned,eitherfortitleoruse.
6.3IntheeventeitherofcancellationbynoticeorofautomaticterminationofthisinsurancebyreasonoftheoperationofthisClause6,orofthesaleoftheVessel,proratanetreturnofpremiumshallbepayabletotheAssured.
6.1本保险得由保险人或被保险人提前7天发出通知而注消（此种注消自保险人发出或收到注消通知的当日午夜起届满7天时生效）。不过，受保险人与被保险人在此种注消通知届满前，就新的保险费率及/或条件和/或保证达成了协议的制约，保险人同意恢复本保险。
6.2无论是否已发出此种注消通知，本保险在下列情况下自动终止。
6.2.1在下述任何国家之间爆发战争（无论宣战与否）
英国、美国、法国、俄国、中国
6.2.2若保险船舶被征用（无论是所有权还是使用权）
6.3若本保险因注消通知而注消或因本第6条规定的原因或因保险船舶出售自动终止时，净保险费应按比例退还给被保险人。
注意事项：
Thisinsuranceshallnotbecomeeffectiveifsubsequenttoitsacceptancebytheunderwritersandpriortotheintendedtimeofitsattachment,therehasoccurredanyeventwhichwouldhaveautomaticallyterminatedthisinsuranceundertheprovisionsofclause6above.
如果在保险人接受保险之后，在约定的生效时间之前，发生任何根据上述第6条将导致自动终止本保险的事件，本保险将不生效。
