第1条风险条款(RisksClause)
Clause1---RisksClause
1Thisinsurancecovers,exceptasprovidedinClause3and4below,lossofor
damagetothesubject-matterinsuredcauseby
1.1strikers,locked-outworkmen,orpersonstakingpartinlabourdisturbances,
riotsorcivilcommotions
1.2anyterroristoranypersonactingfromapoliticalmotive.
1本保险承保下列原因造成的保险标的的损失或损害，第3和第4条规定者除外：
1.1罢工者、闭厂工人或参加劳资纠纷、暴乱或民事骚乱的人员
1.2任何恐怖分子或出于政治动机而行为的人员。
第2条共同海损条款(GeneralAverageClause)
2Thisinsurancecoversgeneralaverageandsalvagecharges,adjustedordeteror
determinedaccordingtothecontractofaffreightmentand/orthegoverninglawandpractice,incurredtoavoidorinconnectionwiththeavoidanceoflossfromariskcoveredundertheseclause.
2本保险承保根据货物合同及/或管辖的法律和惯例理算或确定的，为避免根据这些条款承保的风险造成的损失或与避免该损失有关的共同海损和救助费用。
除外责任
第3条一般除外条款(GeneralExclusionsClause)
3Innocaseshallthisinsurancecover
3.1lossdamageorexpenseattributabletowilfulmisconductoftheAssured
3.2ordinaryleakage,ordinarylossinweightorvolume,orordinarywearandtearofthesubject-matterinsured
3.3lossdamagedorexpensecausedbyinsufficiencyorunsuitabilityofpackingorpreparationofthesubject-matterinsured(forthepurposeofthisClause3.3“packing”shallbedeemedtoinclude
3.4lossdamageorexpensecausedbyinherentviceornatureofthesubject-matterinsured
3.5lossdamageorexpenseproximatelycausedbydelay,eventhoughthedelaybecausedbyariskinsuredagainst(expensespayableunderClause2above)
3.6lossdamageorexpensearisingfrominsolvencyorfinancialdefaultoftheownersmanagerscharterersoroperationsofthevessel
3.7lossdamageorexpensearisingfromtheabsenceshortageorwithholdingoflabourofanydescriptionwhatsoeverresultingfromanystrike,lockout,labourdisturbance,riotorcivilcommotion
3.8anyclaimbaseduponlossoforfrustrationofthevoyageoradventure
3.9lossdamageorexpensearisingfromtheuseofanyweaponofwaremployingatomicornuclearfissionand/orfusionorotherlikereactionorradioactiveforceormatter
3.10lossdamageorexpensecausedbywarcivilwarrevolutionrebellioninsurrection,orcivilstrifearisingtherefrom,oranyhostileactbyoragainstabelligerentpower.
3本保险不承保：
3.1可归因于被保险人的故意渎职行为造成的灭失、损害或费用
3.2保险标的的通常渗漏、通常重量或体积损失、或通常磨损
3.3保险标的的包装、或准备不足或不当造成的灭失、损害或费用（在本款意义上，“包装”应视为包括集装箱或托盘内的积载，但仅限于此种积载是在本保险责任开始之前进行或是由被保险人或其雇员进行之场合）。
3.4保险标的的固有缺陷或性质造成的灭失、损害或费用
3.5延迟直接造成的灭失、损害或费用，即便该延迟是由某种承保危险造成的（但根据上述第2条支付的费用除外）
3.6因船舶所有人、管理人、承租人或经营人的无偿付能力或财务困境引起的灭失、损害或费用
3.7由于无论何种类型的罢工、闭厂、劳资纠纷、暴乱或民事骚乱所致的劳工缺乏、短缺或抵制引起的灭失、损害或费用
3.8基于航程或冒险的损失或落空的任何索赔
3.9使用原子或核裂变和/或聚变或其他类似反应或放射性力量或物质制造的任何战争武器产生的灭失、损害或费用。
3.10战争、内战、革命、叛乱、暴动，或由此引起的内乱，或交战团体之间的任何敌对行为造成的灭失、损害或费用。
第4条不适航和不适运条款(UnseaworthinessandUnfitnessExclusionClause)
44.1Innocaseshallthisinsurancecoverlossdamageorexpensearisingfrom
unseaworthinessofvesselorcraft,
unfitnessofvesselcraftconveyancecontainerorliftvanforthesafecarriageof
thissubject-matterinsured,
wheretheAssuredortheirservantsareprivytosuchunseaworthinessorunfitness,at
thetimethesubject-matterinsuredisloadedtherein.
4.2TheUnderwriterswaiveanybreachoftheimpliedwarrantiesofseaworthinessofthe
Shipandfitnessoftheshiptocarrythesubject-matterinsuredtodestination,unlesstheAssuredortheirservantsareprivytosuchunseaworthinessorunfitness.
4.1本保险在任何情况下，均不承保因下述原因所致的灭失、损害或费用：
船舶或驳船不适航
船舶、驳船、运输工具、集装箱和托盘对安全运输保险标的不适合
在保险标的被装上船舶当时，被保险人或其雇员对此种不适航或不适合有私谋。
4.2保险人放弃运载保险标的至目的港的船舶不得违反船舶适航和适运的任何默示保证，除非被保险人或其雇员对此种不适航或不适运有私谋。
责任期间(duration)
第5条风险的责任期间(DurationoftheRisk)
55.1Thisinsuranceattachesfromthetimethegoodsleavethewarehouse
orplaceofstorageattheplacenamedhereinforthecommencementof
thetransit,continuesduringtheordinarycourseoftransitandtransit
andterminateseither
5.1.1ondeliverytotheConsignees’orotherfinalwarehouseorplace
ofstorageatthedestinationnamedherein,
5.1.2ondeliverytoanyotherwarehouseorplaceofstorage,whether
priortooratthedestinationnamedherein,whichtheAssuredelect
touseeither
5.1.2.1forstorageotherthanintheordinarycourseoftransitor
5.1.2.2forallocationordistribution,
or
5.1.3ontheexpiryof60daysaftercompletionofdischargeoversideof
thegoodsherebyinsuredfromtheoverseavesselatthefinalport
ofdischarge,
whichevershallfirstoccur.
5.2If,afterdischargeoversidefromtheoverseavesselatthefinalportofdischarge,butpriortoterminationofthisinsurance,thegoodsaretobeforwardedtoadestinationotherthanthattowhichtheyareinsuredhereunder,thisinsurance,whilstremainingsubjecttoterminationasprovidedforabove,shallnotextendbeyondthecommencementoftransittosuchotherdestination.
5.3Thisinsuranceshallremaininforce(subjecttoterminationas
ProvidedforaboveandtotheprovisionsofClause6below)duringdelaybeyondthecontroloftheAssured,anydeviation,forceddischarge,reshipmentortransshipmentandduringanyvariationoftheadventurearisingfromtheexerciseofalibertygrantedtoshipownersorcharterersunderthecontractofaffreightment.
5.1本保险责任始于货物运离保险单载明的仓库或贮存处所开始运送之时，在运送的通常过程期间持续，终止于：
5.1.1在载明的目的地交付到收货人的或其他最后仓库或贮存处所
5.1.2在载明的目的地或之前交付到任何其仓库或贮存处所，由被保险人用于：
5.1.2.1运送的通常过程以外的贮存或
5.1.2.2分配或分派，或
5.1.3被保险货物在最后卸货港全部卸离来自海外的船舶满60天，
以上各项以先发生者为准。
5.2如果在最后卸货港卸离来自海外的船舶后，但在本保险终止之前，货物被转运至非保险承保的其他目的地，本保险在依然受前述规定的终止制约的同时，截止于开始向此种其他目的地运送之时。
5.3在被保险人不能控制的延迟、任何绕航、强制卸货、重装或转运期间，以及船东或承租人行使根据货运合同赋予的自由权引起的海上冒险的任何变更期间，本保险仍然有效（但须受上述规定的终止和下述第9条规定的制约）。
第6条运输合同的终止条款(TerminationoftheContractofCarriage)
6IfowingtocircumstancesbeyondthecontroloftheAssuredeitherthecontractofcarriageisterminatedataportorplaceorplaceotherthanthedestinationnamedthereinorthetransitisotherwiseterminatedbeforedeliveryofthegoodsasprovidedforinClause5above,thenthisinsuranceshallalsoterminatedunlesspromptnoticeisgiventotheUnderwritersandcontinuationofcoverisrequestedwhentheinsuranceshallremaininforce,subjecttoanadditionalpremiumifrequiredbytheUnderwriters,either
6.1untilthegoodsaresoldanddeliveredatsuchportorplace,or,unlessotherwisespeciallyagreed,untiltheexpiryof60daysafterarrivalofthegoodsherebyinsuredatsuchportorplace,whichevershallfirstoccur,or
6.2ifthegoodsareforwardedwithinthesaidperiodof60days(oranyagreedextensionthereof)tothedestinationnamedhereinortoanyotherdestination,untilterminatedinaccordancewiththeprovisionsofClause5above.
6如果由于被保险人不能控制的情况，运输合同在保险单载明的目的地以外的港口或地点终止，或运送在上述第5条规定的交付货物前另行终止，那么本保险也终止，除非迅速地通知了保险人且在本保险仍有效时要求继续承保，并受保险人要求的附加保险费的制约：
6.1直至货物在此种港口或地点出售并交付，或除非另有特别约定，直至承保货物到达此种港口或地点满60天，二者以先发生者为准，或
6.2如果货物在上述60天（或任何约定的延展期间）内被运往保险单载明的目的地或其他目的地，直至根据上述第5条的规定而终止。
第7条目的地变更条款(ChangeofDestination)
7Where,afterattachmentofthisinsurance,thedestinationischangedbytheAssure,heldcoveredatapremiumandonconditionstobearrangedsubjecttopromptnoticebeinggiventotheUnderwriters.
7如果在本保险责任开始后，被保险人变更目的地，应按重新商定的保险费率和条件续保，但以迅速通知了保险人为前提。
索赔
第8条可保利益条款(InsurableInterestClause)
88.1InordertorecoverunderthisinsurancetheAssuredmusthaveaninsurableinterestinthesubject-matterinsuredatthetimeoftheloss.
8.2Subjectto8.1above,theAssuredshallbeentitledtorecoverforinsuredlossoccurringduringtheperiodcoveredbythisinsurance,notwithstandingthatthelossoccurredbeforethecontractofinsurancewasconcluded,unlesstheAssuredwereawareofthelossandtheUnderwriterswerenot.
8.1为了根据本保险索赔，在保险标的的损失当时，被保险人必须具有某种可保利益。
8.2根据上述8.1款，被保险人有权索赔在本保险承保期间发生的承保损失，尽管该灭失发生于本保险合同成立之前，除非被保险人已知悉该灭失，而保险人不知情。
第9条增值条款(IncreasedValueClause)
99.1IfanyIncreasedValueinsuranceiseffectedbytheAssuredonthecargo
insuredhereintheagreedvalueofthecargoshallbedeemedtobe
increasedtothetotalamountinsuredunderthisinsuranceandallIncreased
Valueinsurancecoveringtheloss,andliabilityunderthisinsuranceshall
Beinsuchproportionasthesuminsuredhereinbearstosuchtotalamount
Insured.
IntheeventofclaimtheAssuredshallprovidedtheUnderwriterswith
Evidenceoftheamountsinsuredunderallotherinsurance.
9.2wherethisinsuranceisonIncreasedValuethefollowingclauseshallapply:
Theagreedvalueofthecargoshallbedeemedtobeequaltothetotal
amountinsuredundertheprimaryinsuranceandallIncreasedValue
insurancecoveringthelossandeffectedonthecargobytheAssured,and
liabilityunderthisinsuranceshallbeinsuchproportionasthesuminsured
hereinbearstosuchtotalamountinsured.
IntheeventofclaimtheAssuredshallprovidetheUnderwriterswith
Evidenceoftheamountsinsuredunderallotherinsurance.
9.1如果被保险人对保险货物办理了增值保险，货物的约定价值应视为增加至本保险和承保灭失的所有增值保险的保险金额的总和，本保险项下的责任应按承保金额占此种保险金额的总和的比例计算。
倘若提出索赔，被保险人应向保险人提供所有其他保险的保险金额的证据。
9.2在本保险是增值保险的情况下，应适用下述条款：货物的约定价值应视为等于由被保险人对货物办理的原始保险和承保灭失的所有增值保险的保险金额的总和，本保险项下的责任应按承保金额占此种保险金额的总和的比例计算。
万一提出索赔，被保险人应向保险人提供所有其他保险的保险金额的证据。
保险的利益（BenefitofInsurance）
第10条不生效条款(NottoInureClause)
10Thisinsuranceshallnotinuretothebenefitofthecarrierorotherbailee.
10承运人或其他保管人不得主张本保险的利益。
尽量减少损失(MinimisingLosses)
第11条被保险人的义务条款(DutyofAssuredClause)
11ItisthedutyoftheAssuredandtheirservantsandagentsinrespectofloss
Recoverablehereunder
11.1totakesuchmeasuresasmaybereasonableforthepurposeofaverting
orminimisingsuchloss,and
11.2toensurethatallrightsagainstcarriers,baileesorotherthirdpartiedare
properlypreservedandexercised
andtheUnderwriterswill,inadditiontoanylossrecoverablehereunder,reimburse
theAssuredforanychargeproperlyandreasonablyincurredinpursuanceoftheseduties.
11有关可索赔的损失，被保险人及其雇员和代理人有下述义务：
11.1采取为避免或尽量减少此种损失的合理措施，并
11.2确保对承运人、保管人或其他第三方追偿的所有权利被适当保留和行使。
第12条：弃权条款(WaiverClause)
12MeasurestakenbytheAssuredortheUnderwriterswiththeobjectofsaving,
Protectingorrecoveringthesubject-matterinsuredshallnotbeconsideredasa
Waiveroracceptanceofabandonmentorotherwiseprejudicetherightsofeitherparty.
被保险人或保险人采取的旨在拯救、保护或恢复保险标的的措施不得视为放弃或接受委付或在其他方面损害任何一方的权利。
第13条合理速办条款(ReasonableDespatchClause)
13ItisaconditionofthisinsurancethatAssuredshallactwithreasonabledespatchinallcircumstancewithintheircontrol.
13被保险人应在所有其控制的情况下，合理迅速地行动是本保险的一项条件。
第14条英国法律和惯例条款(EnglishLawandPracticeClause)
14ThisinsuranceissubjecttoEnglishlawandpractice.
14本保险受英国法律和惯例的制约。
NOTE:---ItisnecessaryfortheAssuredwhentheybecomeawareofaneventwhichis“heldcovered”underthisinsurancetogivepromptnoticetotheUnderwriterand
Therighttosuchcoverisdependentuponcompliancewiththisobligation.
注意：当被保险人知悉某种应根据本保险续保的事件时，必须迅速通知保险人，此种续保的权利取决于遵守这一义务。
