    本保险受英国法律和惯例制约。
    第1条航行条款
    1NAVIGATION
    1.1Thesubject-matterinsurediscoveredsubjecttotheprovisionsofthisinsuranceatalltimesandtheVesselhasleavetosailornavigatewithorwithoutpilots,togoontrialtripsandtoassistandtowvesselsorcraftindistress,butitiswarrantedthattheVesselshallnotbetowed,exceptasiscustomaryortothefirstsafeportorplacewheninneedofassistance,orundertaketowageorcustomaryortothefirstsafeportorplacewheninneedofassistance,orundertaketowageorsalvageservicesunderacontractpreviouslyarrangedbytheAssuredand/orOwnersand/orManagersand/orCharterers.ThisClause1.1shallnotexcludecustomarytowageinconnectionwithloadinganddischarging.
    1.2ThisinsuranceshallnotbeprejudicedbyreasonoftheAssuredenteringintoanycontractwithpilotsorforcustomarytowagewhichlimitsorexemptstheliabilityofthepilotsand/ortugsand/ortowboatsand/ortheirownerswhentheAssuredortheiragentsacceptorarecompelledtoacceptsuchcontractsinaccordancewithestablishedlocallaworpractice.
    1.3Thepracticeofengaginghelicoptersforthetransportationofpersonnel,suppliesandequipmenttoand/orfromtheVesselshallnotprejudicethisinsurance.
    1.4IntheeventoftheVesselbeingemployedintradingoperationswhichentailcargoloadingordischargingatseafromorintoanothervessel(notbeingaharbourorinshorecraft)noclaimshallberecoverableunderthisinsuranceinrespectoflossofordamagetothesubject-matterinsuredorforliabilitytoanyothervesselarisingfromsuchloadingordischargingoperations,includingwhilstapproaching,lyingalongsideandleaving,unlesspreviousnoticethattheVesselistobeemployedinsuchoperationshasbeengiventotheUnderwritersandanyamendedtermsofcoverandanyadditionalpremiumrequiredbythemhavebeenagreed.
    1.5IntheeventoftheVesselsailing(withorwithoutcargo)withanintentionofbeing(a)brokenup,or(b)soldforbreakingup,noclaimshallberecoverableunderthisinsuranceinrespectoflossordamagetotheVesseloccurringsubsequenttosuchsailingunlesspreviousnoticehasbeengiventotheUnderwritersandanyamendmentstothetermsofcover,amountinsuredandpremiumrequiredbythemhavebeenagreed.
    1航行
    1.1保险船舶在所有时间根据本保险的各项规定承保,并许可在有或没有引航员的情况下开航或试航及协助、拖带遇险船舶或驳船,但保证保险船舶不得被拖带,除非是习惯性的,或当需要协助时,被拖带至第一个安全港口或地点,也不得根据被保险人、船舶所有人、管理人和/或承租人事先安排的合同从事拖带或救助服务。但本条第1.1款不排除与装卸有关的习惯拖带。
    1.2本保险不因被保险人签订限制或免除引航员和/或拖船和/或其所有人责任的引航或习惯拖带的任何合同而受损害,如果被保险人或其代理人根据既定的当地法律或惯例接受或被迫接受此种合同。
    1.3雇用直升飞机向保险船舶运送和/或从保险船舶运出人员、供应品或设备不损害本保险。
    1.4若保险船舶被雇用于在海上将货物装卸入他船(非港口或近岸驳船)或自他船装卸入本船的商业作业,由于此种装卸作业,包括两船驶近,并排停靠和驶离,造成保险船舶的灭失或损害或对他船的责任,不得根据本保险索赔,除非保险船舶被雇用于此种作业前已通知保险人,且已同意保险人要求的修改承保条件及任何附加的保险费。
    1.5如果保险船舶开航(不论有无货载)旨在(a)拆船或(b)为拆船而出售,那么对保险船舶在此种开航后发生的灭失或损害的任何索赔,应限于船舶灭失和损坏时报废船舶的市场价值,除非事先已通知保险人,并已同意修改保险条款,保险价值和保险人要求的保险费。
   
    第2条延续条款
    2CONTINUATION
    ShouldtheVesselattheexpirationofthisinsurancebeatseaandindistressormissing,sheshall,providednoticebegiventotheUnderwriterspriortotheexpirationofthisinsurance,beheldcovereduntilarrivalatthenextportingoodsafety,orifinportandindistressuntiltheVesselismadesafe,ataproratamonthlypremium.
    2延续
    如果在本保险期届满时,保险船舶在海上遇险或失踪,若在本保险期限届满以前已通知保险人,船舶将被继续承保,直至安全抵达下一个港口;或者如果保险船舶在港内并遇险,则直至保险船舶变得安全时,超期保险费按月比例支付。
   
    第3条违反保证条款
    3Breachofwarranty
    Heldcoveredincaseofanybreachofwarrantyastocargo,locality,trade,towage,salvageservicesordateofsailing,providednoticebegiventotheUnderwritersimmediatelyafterreceiptofadvicesandanyamendedtermsofcoverandanyadditionalpremiumrequiredbythembeagreed.
    3违反保证
    当任何有关货物、贸易、船位、拖带,救助服务或开航日期的保证被违反时,若被保险人知悉后立即通知保险人,并同意保险人要求的承保条款的任何修改及附加保险费,本保险继续有效。
   
    第4条船级条款
    4CLASSIFICATION
    4.1ItisthedutyoftheAssured,OwnersandManagersattheinceptionofandthroughouttheperiodofthisinsurancetoensurethat
    4.1.1theVesselisclassedwithaClassificationSocietyagreedbytheUnderwritersandthatherclasswithinthatSocietyismaintained
    4.1.2anyrecommendationsrequirementsorrestrictionsimposedbytheVessel’sClassificationSocietywhichrelatetotheVessel’sseaworthinessortohermaintenanceinaseaworthyconditionarecompliedwithbythedatesrequiredbythatSociety.
    4.2IntheeventofanybreachofthedutiessetoutinClause4.1above,unlesstheUnderwritersagreetothecontraryinwriting,theywillbedischargedfromliabilityunderthisinsuranceasfromthedateofthebreachprovidedthatiftheVesselisatseaatsuchdatetheUnderwritersdischargefromliabilityisdeferreduntilarrivalathernextport.
    4.3AnyincidentconditionordamageinrespectofwhichtheVessel’sClassificationSocietymightmakerecommendationsastorepairsorotheractiontobetakenbytheAssured,OwnersorManagersmustbepromptlyreportedtotheClassificationSociety.
    4.4ShouldtheUnderwriterswishtoapproachtheClassificationSocietydirectlyforinformationand/ordocuments,theAssuredwillprovidethenecessaryauthorization.
    4船级
    4.1被保险人、船舶所有人和管理人有义务在本保险责任开始和整个保险期间保证:
    4.1.1保险船舶在保险人同意的船级社入级并维持该船级社船级
    4.1.2该船级社提出的有关船舶适航性或维持其适航条件的任何建议,要求或限制,应在该船级社要求的日期前执行
    4.2倘若发生上述第4.1款规定的义务的任何违反,除非保险人另行书面同意,保险人得自违反之日起解除根据本保险的责任,但若当时保险船舶在海上,保险人延至其抵达下一港口时解除责任。
    4.3对船级社可能建议被保险人修理或采取其他措施的任何事件、条件、损害,船舶所有人或管理人必须迅速报告给船级社
    4.4如果保险人要求直接向船级社取得信息和/或文件,被保险人应提供必要的授权。
   
    第5条终止条款
    5TERMINATION
    ThisClause5shallprevailnotwithstandinganyprovisionwhetherwrittentypedorprintedinthisinsuranceinconsistenttherewith.
    UnlesstheUnderwritersagreetothecontraryinwriting,thisinsuranceshallterminateautomaticallyatthetimeof
    5.1changeoftheClassificationSocietyoftheVessel,orchange,suspension,discontinuance,withdrawalorexpiryofherClasstherein,oranyoftheClassificationSociety’speriodicsurveysbecomingoverdueunlessanextensionoftimeforsuchsurveybeagreedbytheClassificationSociety,providedthatiftheVesselisatseasuchautomaticterminationshallbedeferreduntilarrivalathernextport.Howeverwheresuchchange,suspension,discontinuanceorwithdrawalofherClassorwhereaperiodicsurveybecomingoverduehadresultedfromlossordamagecoveredbyClause6ofthisinsuranceorwhichwouldbecoveredbyaninsuranceoftheVesselsubjecttocurrentInstituteTimeClauses-HullsorInstituteWarandStrikesClausesHulls-TimesuchautomaticterminationshallonlyoperateshouldtheVesselsailfromhernextportwithoutthepriorapprovaloftheClassificationSocietyorinthecaseofaperiodicsurveybecomingoverduewithouttheClassificationSocietyhavingagreedanextensionoftimeforsuchsurvey,
    5.2anychange,voluntaryorotherwise,intheownershiporflag,transfertonewmanagement,orcharteronabareboatbasis,orrequisitionfortitleoruseoftheVessel,providedthat,iftheVesselhascargoonboardandhasalreadysailedfromherloadingportorisatseainballast,suchautomaticterminationshallifrequiredbedeferred,whilsttheVesselcontinuesherplannedvoyage,untilarrivalatfinalportofdischargeifwithcargooratportofdestinationifinballast.However,intheeventofrequisitionfortitleorusewithoutthepriorexecutionofawrittenagreementbytheAssured,suchautomaticterminationshalloccurfifteendaysaftersuchrequisitionwhethertheVesselisatseaorinport.
    AproratadailynetreturnofpremiumshallbemadeprovidedthatatotallossoftheVessel,whetherbyinsuredperilsorotherwise,hasnotoccurredduringtheperiodcoveredbythisinsuranceoranyextensionthereof.
    5终止
    本保险的任何条款,不论是手写的,打印的还是印刷的,凡与本条不一致者,均以本条为准。
    除非保险人书面另行同意,本保险在下列情况发生时自动终止:
    5.1保险船舶的船级社变更,或其船级变更、暂停、终止、撤回或期满,或船级社的定期检验过期,除非船级社同意延期进行此种检验,但如果船舶在海上,此种自动终止应延迟到船舶抵达一港口时。然而,如果此种船级变更、暂停、终止、撤回,或定期检验过期,是由本保险第6条承保的灭失或损害造成的,或是由根据现行协会船舶战争险和罢工险定期保险条款承保的灭失或损害引起的,此种自动终止,仅于船舶未经船级社事先同意在下一港口开航时,或在定期检验过期的情况下,船级社未同意延期进行此种检验时,才生效。
    5.2自愿或以其他方式变更船舶所有权或船旗,转级新的管理人,光船出租或被征购、征用,但如果船上载有货物且已从装货港开航,或在海上空载航行,经要求,此种自动终止应延迟,直至船舶继续其计划航程,载货船舶到达最后卸货港为止,空载船舶到达目的港为止。不过,如果征购、征用未事先与被保险人签订书面协议,那么无论船舶是在海上还是在港内,此种自动终止将在船舶被征用后15天生效。
    净保险费按比例退还,但以在本保险承保期间或其延展期间保险船舶未发生全损为条件,不论全损是否由承保危险造成。
   
    第6条危险条款
    6PERILS

    6.1.6contactwithlandconveyance,dockorharbourequipmentorinstallation
    6.1.7earthquakevolcaniceruptionorlightning
    6.1.8accidentsinloadingdischargingorshiftingcargoorfuel
    6.2Thisinsurancecoverstotalloss(actualorconstructive)ofthesubject-matterinsuredcausedby
    6.2.1burstingofboilersbreakageofshaftsoranylatentdefectinthemachineryorhull
    6.2.2negligenceofMasterOfficersCreworPilots
    6.2.3negligenceofrepairersorcharterersprovidedsuchrepairersorcharterersarenotanAssuredhereunder
    6.2.4barratryofMasterOfficersorCrew
    6.2.5contactwithaircraft,helicoptersorsimilarobjects,orobjectsfallingtherefromprovidedsuchlosshasnotresultedfromwantofduediligencebytheAssured,Owners,ManagersorSuperintendentsoranyoftheironshoremanagement.
    6.3MastersOfficersCreworPilotsnottobeconsideredOwnerswithinthemeaningofthisClause6shouldtheyholdsharesintheVessel.
    6.4Thisinsurancecovers:
    6.4.1GeneralAverage,SalvageandSalvageChargerecoverableundertheinsurancesonhullandmachinerybutnotrecoverableinfullbyreasonofthedifferencebetweentheinsuredvalueoftheVesselasstatedtherein(oranyreducedvaluearisingfromthedeductiontherefrominprocessofadjustmentofanyclaimwhichlaworpracticeorthetermsoftheinsurancecoveringhullandmachinerymayhaverequired)andthevalueoftheVesseladoptedforthepurposeofcontributiontogeneralaverage,salvageorsalvagecharges,theliabilityunderthisinsurancebeingforsuchproportionoftheamountnotrecoverableastheamountinsuredhereunderbearstothesaiddifferenceortothetotalsuminsuredagainstexcessliabilitiesifitexceedsuchdifference.
    6.4.2SueandLabourChargesrecoverableundertheinsurancesonhullandmachinerybutnotrecoverableinfullbyreasonofthedifferencebetweentheinsuredvalueoftheVesselasstatedthereinandthevalueoftheVesseladoptedforthepurposeofascertainingtheamountrecoverableundertheinsurancesonhullandmachinery,theliabilityunderthisinsurancebeingforsuchproportionoftheamountnotrecoverableastheamountinsuredhereunderbearstothesaiddifferenceortothetotalsuminsuredagainstexcessliabilitiesifitexceedsuchdifference.
    6.4.3CollisionLiability(three-fourths)recoverableundertheInstitute3/4thsCollisionLiabilityandSistershipClausesintheinsurancesonhullandmachinerybutnotrecoverableinfullbyreasonofsuchthree-fourthsliabilityexceedingthree-fourthsoftheinsuredvalueoftheVesselasstatedtherein,inwhichcasetheamountrecoverableunderthisinsuranceshallbesuchproportionofthedifferencesoarisingastheamountinsuredhereunderbearstothetotalsuminsuredagainstexcessliability.
    6.5Theunderwriters’liabilityunder6.4.1,6.4.2and6.4.3separately,inrespectofanyoneclaim,shallnotexceedtheamountinsuredhereunder.
    6危险
    6.1本保险承保下列原因造成保险标的的(实际或推定)全损:
    6.1.1海上、江河、湖泊或其他可航水域的危险
    6.1.2火灾、爆炸
    6.1.3来自保险船舶外部的人员的暴力盗窃
    6.1.4抛弃
    6.1.5海盗
    6.1.6与陆上运输工具、码头、或港口设备、设施接触
    6.1.7地震、火山爆发或闪电
    6.1.8装卸或搬移货物或燃料过程中的意外事故。
    6.2本保险承保下列原因引起的保险标的的(实际或推定)全损
    6.2.1锅炉破裂、尾轴断裂、或者机器、船壳的潜在缺陷
    6.2.2船长、高级船员、船员或引航员的过失
    6.2.3修船人或承租人的过失,如果此种修船人或承租人不是本保险的被保险人
    6.2.4船长、高级船员、船员的欺诈恶行
    6.2.5与航空器、直升飞机或类似物体,或从其上坠落的物体触碰,如果此种灭失或损害并非由于被保险人、船东、管理人或船技主管或其岸上管理人员未谨慎处理所致。
    6.3船长、高级船员、船员或引航员拥有保险船舶股份的,也不视作本第6条意义上的船东。
    6.4本保险承保:
    6.4.1共同海损、救助和救助费用。根据本船体和机器保险可以获得补偿,但未获全额补偿是由于船舶的保险价值(或在理赔过程中按承保船体和机器保险的法律、惯例或条款要求予以扣减后减少了的价值)与船舶分摊了共同海损、救助或救助费用之后的价值之间存在差额,根据本保险的责任,按照本保险的保险金额与该差额的比例,或当承保额外责任的保险金额总和超过该差额时,按本保险的保险金额与该保险金额的总和的比例,承担责任。
    6.4.2施救费用。根据本船体和机器保险可以获得补偿,但未获全额补偿是由于船舶的保险价值与为确定根据船体和机器保险的补偿额采用的船舶价值之间存在差额,本保险下的责任为按照本保险的保险金额与该差额的比例,或当承保额外责任的保险金额总和超过该差额时,按本保险的保险金额与该保险金额的总和的比例,承担责任。
    6.4.3(3/4)碰撞责任。根据协会船体和机器3/4碰撞责任条款和姐妹船条款可以获得补偿,但未获全额补偿,是由于此种3/4碰撞责任超过了保险船舶的3/4保险金额而存在差额,本保险下可获补偿的金额,按本保险的保险金额与承保额外责任的保险金额的总和的比例计算。
    6.5保险人分别根据上述6.4.1项,6.4.2项和6.4.3项的责任,有关任何一次索赔,不得超过本保险的保险金额。
   
    第7条污染危险条款
    7POLLUTIONHAZARD
    Thisinsurancecoverstotalloss(actualorconstructive)oftheVesselcausedbyanygovernmentalauthorityactingunderthepowersvestedinittopreventormitigateapollutionhazardordamagetotheenvironment,orthreatthereof,resultingdirectlyfromdamagetotheVesselcausedbyaperilcoveredbythisinsurance,providedthatsuchactofgovernmentalauthorityhasnotresultedfromwantofduediligencebytheAssured,OwnersorManagerstopreventormitigatesuchhazardordamage,orthreatthereof.MasterOfficersCreworPilotsnottobeconsideredOwnerswithinthemeaningofthisClause7shouldtheyholdsharesintheVessel.
    7污染危险
    本保险承保由于任何政府当局依其授权,为防止或减少因本保险承保危险造成船舶损害直接引起的污染危险或环境损害或其威胁,采取行动造成的保险船舶的(实际或推定)全损,如果政府当局的此种行为不是由于保险船舶的被保险人、船舶所有人或管理人在防止或减轻此种危险或损害或其威胁采取行动方面未谨慎处理所致。若船长、高级船员、船员或引航员持有保险船舶股份,不视为第7条意义上的船东。
   
    第8条索赔通知条款
    8NOTICEOFCLAIM
    Intheeventofaccidentwherebylossordamagemayresultinaclaimunderthisinsurance,noticemustbegiventotheUnderwriterspromptlyafterthedateonwhichtheAssured,OwnersorManagersbecomeorshouldhavebecomeawareofthelossordamageandpriortosurveysothatasurveyormaybeappointediftheUnderwriterssodesire.
    IfnoticeisnotgiventotheUnderwriterswithintwelvemonthsofhatdateunlesstehUnderwritersagreetothecontraryinwriting,theUnderwriterswillbeautomaticallydischargedfromliabilityforanyclaimunderthisinsuranceinrespectoforarisingoutofsuchlossordamage.
    8索赔通知
    如果发生根据本保险可以索赔的损失或损害的意外事故,须在被保险人、船东或管理人知道或应当知道该损失或损害之日后,并在检验前,迅速通知保险人,以便在保险人如此要求时,指定检验人。
    若未在该日起12个月内通知保险人,除非保险人书面作相反的同意,对与此种意外事故或损失、损害有关的或由其引起的根据本保险的任何索赔,保险人自动解除责任。
   
    第9条推定全损条款
    9CONSTRUCTIVETOTALLOSS
    9.1InascertainingwhethertheVesselisaconstructivetotalloss,theinsuredvalueintheinsuranceonhullandmachineryshallbetakenastherepairedvalueandnothinginrespectofthedamagedorbreak-upvalueoftheVesselorwreckshallbetakenintoaccount.
    9.2Noclaimforconstructivetotallossbaseduponthecostofrecoveryand/orrepairoftheVesselshallberecoverablehereunderunlesssuchcostwouldexceedtheinsuredvalueintheinsuranceonhullandmachinery.Inmakingthisdetermination,onlythecostrelatingtoasingleaccidentorsequenceofdamagesarisingfromthesameaccidentshallbetakenintoaccount.
    9.3ProvidedthattheConstructiveTotalLossClauseinthecurrentInstituteTimeClausesHullsoraclausehavingasimilareffectiscontainedintheinsuranceonhullandmachinery,thesettlementofaclaimforconstructivetotallossthereundershallbeacceptedasproofoftheconstructivetotallossoftheVessel.
    9.4ShouldtheVesselbeaconstructivetotallossbuttheclaimontheinsuranceonhullandmachinerybesettledasaclaimforpartialloss,,nopaymentshallbedueunderthisClause9.
    9推定全损
    9.1在确定船舶是否构成推定全损时,船舶的保险价值应以船舶修理后的价值为准,不应考虑船舶或残骸的受损或解体价值。
    9.2基于保险船舶的恢复和/或修理费用不能据此得到赔偿,除非此种费用已超过保险价值。在作此项决定时,仅应考虑与单一事故或由于同一事故引起的后续损害赔偿有关的费用。
    9.3如果船体和机器保险中包含现行协会船舶定期保险条款的推定全损条款或具有相似效果的条款,据此按推定全损解决索赔,应接受为保险船舶推定全损的证据。
    9.4若保险船舶构成推定全损,但根据船体和机器保险的索赔是按照部分损失解决索赔者,保险人根据本第9条不负赔偿责任。
   
    第10条折衷全损
    10COMPROMISEDTOTALLOSS
    Intheeventofaclaimfortotallossorconstructivetotallossbeingsettledontheinsuranceonhullandmachineryasacompromisedtotallosstheamountpayablehereundershallbethesamepercentageoftheamountinsuredasispaidonthesaidinsurance.
    10折衷全损
    倘若船体和机器保险按折衷全损赔付全损或推定全损,应按该保险的保险金额相同的赔付比例,支付本保险的保险金额。
   
    第11条转让条款
    11ASSIGNMENT
    NoassignmentoforinterestinthisinsuranceorinanymoneyswhichmaybeorbecomepayablethereunderistobebindingonorrecognisedbytheUnderwritersunlessadatednoticeofsuchassignmentorinterestsignedbytheAssuredandbytheassignorinthecaseofsubsequentassignment,isendorsedonthePolicyandthePolicywithsuchendorsementisproducedbeforepaymentofanyclaimorreturnofpremiumthereunder.
    11转让
    本保险利益或依本保险得付或应付款项的转让,除非经被保险人,和在后续转让时经受让人,签署载有日期的此种转让通知批注在保险单上,并在支付赔偿或退还保险费前,将如此批注的保险单提交给保险人,不约束保险人或被保险人。
   
   
    第12条停泊和解约时的退费条款
    12RETURNSFORLAY-UPANDCANCELLATION
    12.1Toreturnasfollows:
    12.1.1proratamonthlynetforeachuncommencedmonthifthisinsurancebecancelledbyagreement,
    12.1.2foreachperiodof30consecutivedaystheVesselmaybelaidupinaportorinalay-upareaprovidedsuchportorlay-upareaisapprovedbytheUnderwriters
    (a)percentnetnotunderrepair
    (b)percentnetunderrepair
    12.1.3TheVesselshallnotbeconsideredtobeunderrepairwhenworkisundertakeninrespectofordinarywearandtearoftheVesseland/orfollowingrecommendationsintheVessel’sClassificationSocietysurvey,butanyrepairsfollowinglossofordamagetotheVesselorinvolvingstructuralalterations,whethercoveredbythisinsuranceorotherwiseshallbeconsideredasunderrepair.
    12.1.4IftheVesselisunderrepairduringpartonlyofaperiodforwhichareturnisclaimable,thereturnshallbecalculatedproratatothenumberofdaysunder12.1.2(a)and(b)respectively.
    12.2PROVIDEDALWAYSTHAT
    12.2.1atotallossoftheVessel,whetherbyinsuredperilsorotherwise,hasnotoccurredduringtheperiodcoveredbythisinsuranceoranyextensionthereof
    12.2.2innocaseshallareturnbeallowedwhentheVesselislyinginexposedorunprotectedwaters,orinaportorlay-upareanotapprovedbytheUnderwriters
    12.2.3loadingordischargingoperationsorthepresenceofcargoonboardshallnotdebarreturnsbutnoreturnshallbeallowedforanyperiodduringwhichtheVesselisbeingusedforthestorageofcargoorforlighteningpurposes
    12.2.4intheeventofanyamendmentoftheannualrate,theaboveratesofreturnshallbeadjustedaccordingly
    12.2.5intheeventofanyreturnrecoverableunderthisClause12beingbasedon30consecutivedayswhichfallonsuccessiveinsuranceseffectedforthesameAssured,thisinsuranceshallonlybeliableforanyamountcalculatedatprorataoftheperiodrates12.1.2(a)and/or(b)aboveforthenumberofdayswhichcomewithintheperiodofthisinsuranceandtowhichareturnisactuallyapplicable.Suchoverlappingperiodshallrun,attheoptionoftheAssured,eitherfromthefirstdayonwhichtheVesselislaiduporthefirstdayofaperiodof30consecutivedaysasprovidedunder12.1.2(a)or(b)above.
    12停泊和解约时的退费
    12.1按下列规定退还保险费:
    12.1.1若本保险经协议解除,每一未开始的月份的净保险费按月比例退还
    12.1.2如果船舶在保险人认可的港口或停泊水域每次连续停泊30天:
    (a)未进行修理的,按净保险费%计算
    (b)已进行修理的,按净保险费%计算
    12.1.3对船舶正常损耗及/或按照船级社建议进行检验而进行的工作,船舶不应视为正在修理,但因船舶损坏或损害或涉及结构改变的任何修理,无论是否在本保险承保项下均应视为正在修理。
    12.1.4如果保险船舶修理期间,仅部分时间属于可退保险费期间,退费应分别按照第12.1.2(a)和(b)两项中的日数比例计算
    12.2还应符合下列条件:
    12.2.1在本保险的保险期间内或其延续期间内发生保险船舶的全损,不论是否由于承保危险所致
    12.2.2若保险船舶停泊于暴露或无防护的水域,或停泊于未经保险人认可的港口或停泊区,则不予退费。
    12.2.3装卸作业或船上有货物不影响退费,但保险船舶被用作贮藏或驳运货物的任何期间,不允许退费
    12.2.4年保险费率修改时,上述保险费退回率也应作相应调整
    12.2.5根据本条可得到的退费,基于连续30天的停泊期跨越同一被保险人投保的连续保险时,本保险仅负责按上述第12.1.2(a)和(b)分项规定的退费率,对属于本保险的保险期间内的实际停泊天数的比例计算出来的退费。被保险人有权选择此种重叠期应自保险船舶闲置的第一天开始起算,或自上述第12.1.2(a)和(b)分项规定的连续30天期间的第一天开始起算。
   
    第13条至16条除外条款
    下列各条是首要条款,本保险中任何与下列各条不一致的规定,均属无效。
   
    第13条战争除外条款
    13WAREXCLUSION
    Innocaseshallthisinsurancecoverlossdamageliabilityorexpensecausedby
    13.1warcivilwarrevolutionrebellioninsurrection,orcivilstrifearisingtherefrom,oranyhostileactbyoragainstabelligerentpower
    13.2captureseizurearrestrestraintordetainment(barratryandpiracyexcepted),andtheconsequencesthereoforanyattemptthereat
    13.3derelictminestorpedoesbombsorotherderelictweaponsofwar.
    13战争除外
    在任何情况下,本保险不承保由下列原因引起的灭失、损害、责任和费用。
    13.1战争、内战、革命、叛乱、暴动或由此引起的内乱或任何交战团体之间的敌对行为
    13.2捕获、扣押、扣留、管制或拘押(船长、船员的欺诈恶行和海盗除外),及这些行为引起的后果或进行这些行为的企图
    13.3被遗弃的水雷、鱼雷、炸弹或其他被遗弃的战争武器。
   
    第14条罢工除外条款
    14STRIKESEXCLUSION
    Innocaseshallthisinsurancecoverlossdamageliabilityorexpensecausedby
    14.1strikers,locked-outworkmen,orpersonstakingpartinlabourdisturbances,riotsorcivilcommotions
    14.2anyterroristoranypersonactingfromapoliticalmotive.
    14罢工除外
    在任何情况下,本保险不承保由下列原因引起的灭失、损害、责任或费用:
    14.1罢工者、闭厂工人、或参加劳资纠纷、暴乱或民事骚乱的人员
    14.2任何恐怖分子或出于政治动机的人员。
   
    第15条恶意行为除外条款
    15MALICIOUSACTSEXCLUSION
    Innocaseshallthisinsurancecoverlossdamageliabilityorexpensearisingfrom
    15.1thedetonationofanexplosive
    15.2anyweaponofwarandcausedbyanypersonactingmaliciouslyorfromapoliticalmotive.
    15恶意行为除外
    在任何情况下,本保险不承保由下列原因引起的灭失、损害、责任或费用:
    15.1炸药爆炸
    15.2任何战争武器、及由于任何人的恶意行为或政治动机引起者。
   
    第16条放射性污染除外条款
    16RADIOACTIVECONTAMINATIONEXCLUSIONCLAUSE
    Innocaseshallthisinsurancecoverlossdamageliabilityorexpensedirectlyorindirectlycausedbyorcontributedtobyorarisingfrom
    16.1ionisingradiationsfromorcontaminationsbyradioactivityfromanynuclearfuelorfromanynuclearwasteorfromthecombustionofnuclearfuel
    16.2theradioactive,toxic,explosiveorotherhazardousorcontaminatingpropertiesofanynuclearinstallation,reactororothernuclearassemblyornuclearcomponentthereof
    16.3anyweaponofwaremployingatomicornuclearfissionand/orfusionorotherlikereactionorradioactiveforceormatter.
    16放射性污染除外
    在任何情况下,本保险不承保由下列原因直接或间接造成、引起或可归因于其的灭失、损害、责任或费用:
    16.1来自任何核燃料、核废料或核燃料燃烧的电离辐射或放射性污染
    16.2任何核装置、核反应堆、其他核组件或核无件的放射性的,有毒的,爆炸性的或其他危险性或污染性的特性
    16.3应用原子或核裂变和/或核聚变或其他类似反应或放射性力量或物质制造的任何战争武器。
