1982年1月1日协会货物条款（A）第1条风险条款
1Thisinsurancecoversallrisksoflossofordamagetothesubject-matterinsuredexceptasprovidedinclause4,5,6and7below
本保险承保除了下述第4、5、6和7条规定的除外责任以外的保险标的的灭失或损害的一切风险。
第2条共同海损条款(GeneralAverageClause)
2Thisinsurancecoversgeneralaverageandsalvagecharges,adjustedordeterminedaccordingtothecontractofaffreightmentand/orthegoverninglawandpractice,incurredtoavoidorinconnectionwiththeavoidanceoflossfromanycauseexceptthoseexcludedinClause4,5,6and7orelsewhereinthisinsurance.
本保险承保根据货运合同及/或管辖的法律和惯例理算或确定的，为避免或与避免任何原因造成的有关引起共同海损和救助费用的损失，但第4，5，6和7条或本保险其他条文的除外条款除外。
第3条“互有责任碰撞”条款(BothtoBlameCollisionClause)
ThisinsuranceisextendedtoindemnifytheAssuredagainstsuchproportionofliabilityunderthecontractofaffreightment“BothtoBlameCollision”Clauseasisinrespectofalossrecoverablehereunder.IntheeventofanyclaimbyshipownersunderthesaidClausetheAssuredagreetonotifytheUnderwriterswhoshallhavetheright,attheirowncostandexpense,todefendtheAssuredagainstsuchclaim.
本保险扩展赔偿被保险人根据货运合同中“互有责任碰撞”条款的比例责任有关可获赔偿的损失。在船东根据该条款提出任何索赔的情况下，被保险人同意保险人，保险人有权自负费用，为被保险人对此种索赔抗辩。
第4条一般除外条款(GeneralExclusionsClause)
4Innocaseshallthisinsurancecover
在任何情况下本保险不承保
4.1lossdamageorexpenseattributabletowilfulmisconductoftheAssured.
可归因于被保险人的故意不端行为造成的灭失、损害或费用
4.2ordinaryleakage,ordinarylossinweightorvolume,orordinarywearandtearofthesubject-matterinsured
保险标的通常的渗漏、通常重量或体积损失或通常磨损。
4.3lossdamageorexpensecausedbyinsufficiencyorunsuitabilityofpackingorpreparationofthesubject-matterinsured(forthepurposeofthisClause4.3“packing”shallbedeemedtoincludestowageinacontainerorliftvanbutonlywhensuchstowageiscarriedoutpriortoattachmentofthisinsuranceorbytheAssuredortheirservants)
保险标的的包装或准备不足或不当造成的灭失、损害或费用（在本款的意义上，“包装”应视为包括集装箱或托盘内的积载，但仅限于此种积载是在本保险责任开始之前进行或是由被保险人或其雇员进行这场合。）
4.4lossdamageorexpensecausedbyinherentviceornatureofthesubject-matterinsured
保险标的的固有缺陷或性质造成的灭失、损害或费用。
4.5lossdamageorexpenseproximatelycausedbydelay,eventhoughthedelaybecausedbyariskinsuredagainst(exceptexpensespayableunderClause2above).
迟延直接造成的灭失、损害或费用，即便该迟延是由于某种承保风险造成的（但根据上述第2条支付的费用除外）。
4.6lossdamageorexpensearisingfrominsolvencyorfinancialdefaultoftheownersmanagerscharterersoroperatorsofthevessel.
因船舶所有人、管理人、承租人或经营人的无偿付能力或财务困境引起的灭失、损害或费用。
4.7lossdamageorexpensearisingfromtheuseofanyweaponofwaremployingatomicornuclearfissionand/orfusionorotherlikereactionorradioactiveforceormatter
因使用原子或核裂变和/或聚变或其他类似反应或放射性力量或物质造成的任何战争武器产生的灭失、损害或费用。
第5条不适航和不适运除外条款(UnseaworthinesandUnfitnessExclusionClause)
5.1Innocaseshallthisinsurancecoverlossdamageorexpensearisingfrom
unseaworthnessofvesselorcraft,
unfitnessofvesselcraftconveyancecontainerorlifivanforthesafecarriageofthesubject-matterinsured,
wheretheAssuredortheirservantsareprivytosuchunseaworthinessorunfitness,atthetimethesubject-matterinsuredisloadedtherein.
本保险在任何情况下均不承保因下述原因所致的灭失、损害或费用：
船舶或驳船不适航，
船舶、驳船、运输工具、集装箱和托盘对安全运输保险标的不适合，
在保险标的被装上船当时，被保险人或其雇员对此种不适航或不适合有私谋。
5.2TheUnderwriterswaiveanybreachoftheimpliedwarrantiesofseaworthinessoftheshipandfitnessoftheshiptocarrythesubject-matterinsuredtodestination,unlesstheAssuredortheirservantsareprivytosuchunseaworthinessorunfitness.
保险人放弃运载保险标的至目的港的船舶不得违反船舶适航和适运的任何默示保证，除非被保险人或其雇员对此种不适航或不适运有私谋。
第6条战争除外条款(WarExclusionClause)
6Innocaseshallthisinsurancecoverlossdamageorexpensecausedby
6本保险在任何情况下均不承保下述原因造成的灭失、损害或费用
6.1warcivilwarrevolutionrebellioninsurrection,orcivilstrifearisingtherefrom,oranyhostileactbyoragainstabelligerentpower
战争、内战、革命、叛乱、暴动，或由此引起的民间冲突(civilstrife)，或来自交战方或针对交战方的任何敌对行为。
6.2captureseizurearrestrestraintordetainment(piracyexcepted),andtheconsequencesthereoforanyattemptthereat
捕获、扣押、扣留、拘留或羁押（海盗除外），及由此引起的后果或企图这么做的任何威胁。
6.3derelictminestorpedoesbombsorotherderelictweaponsofwar.
丢弃的水雷、鱼雷、炸弹或其他被遗弃的战争武器。
第7条罢工除外条款(StrikesExclusionClause)
7Innocaseshallthisinsurancecoverlossdamageorexpense(
本保险在任何情况下均不承保下列灭失、损害或费用：
7.1causedbystrikers,locked-outworkmen,orpersonstakingpartinlabourdisturbances,riotsorcivilcommotions
由罢工、被迫停工工人或参加工潮、暴乱（riots）民事骚乱（civilcommotions）的人员造成者
7.2resultingfromstrikes,lock-outs,labourdisturbances,riotsorcivilcommotions
罢工、停工、工潮、暴乱或民事骚乱引起者
7.3causedbyanyterroristoranypersonactingfromapoliticalmotive.
恐怖分子或出于政治动机而作为的任何人员造成者。
第8条运输条款(TransitClause)
8.1Thisinsuranceattachesfromthetimethegoodsleavethewarehouseorplaceofstorageattheplacenamedhereinforthecommencementofthetransit,continuesduringtheordinarycourseoftransitandterminateseither
8.1.1ondeliverytotheConsignees’orotherfinalwarehouseorplaceofstorageatthedestinationnamedherein,
8.1.2ondeliverytoanyotherwarehouseorplaceofstorage,whetherpriortooratthedestinationnamedherein,whichtheAssuredelecttouseeither
8.1.2.1forstorageotherthanintheordinarycourseoftransitor
8.1.2.2forallocationordistribution.Or
8.1.3ontheexpiryof60daysaftercompletionofdischargeoversideofthegoodsherebyinsuredfromtheoverseavesselatthefinalportofdischarge,whichevershallfirstoccur.
8.2if,afterdischargeoversidefromtheoverseavesselatthefinalportofdischarge,butpriortoterminationofthisinsurance,thegoodsaretobeforwardedtoadestinationotherthanthattowhichtheyareinsuredhereunder,thisinsurance,whilstremainingsubjecttoterminationasprovidedforabove,shallnotextendbeyondthecommencementoftransittosuchotherdestination.
8.3Thisinsuranceshallremaininforce(subjecttoterminationasprovidedforaboveandtotheprovisionsofClause9below)duringdelaybeyondthecontroloftheAssured,anydeviation,forceddischarge,reshipmentortranshipmentandduringanyvariationoftheadventurearisingfromtheexerciseofalibertygrantedtoshipownersorcharterersunderthecontractofaffreightment.
88.1本保险责任始于货物运离保险单载明的仓库或贮存处所开始运送之时，在运送的通常过程期间持续，终止于
8.1.1在载明的目的地交付到收货人的或其他最后仓库或贮存处所
8.1.2在载明的目的地或之前交付到任何其他仓库或贮存处所，由被保险人用于：
8.1.2.1运送的通常过程以外的贮存或
8.1.2.2分配或分派，或
8.1.3被保险货物在最后卸货港全部卸离来自海外的船舶满60天，
以上各项以先发生者为准
8.2如果在最后卸货港卸离来自海外的船舶后，但在本保险终止之前，货物被转运至非保险承保的其他目的地，本保险在依然受前述规定的终止制约的同时，截止于开始向此种其他目的地运送之时。
8.3在被保险人不能控制的迟延任何绕航、强制卸货、重装或转运期间，以及船东或承租人行使根据货运合同赋予的自由权引起的海上冒险的任何变更期间，本保险仍然有效（但须受上述规定的终止和下述第9条规定的制约）。
第9条运输合同终止条款(TerminationofContractofCarriageClause)
9IfowingtocircumstancesbeyondthecontroloftheAssuredeitherthecontractofcarriageisterminatedataportorplaceotherthanthedestinationnamedthereinorthetransitisotherwiseterminatedbeforedeliveryofthegoodsasprovidedforinClause8above,thenthisinsuranceshallalsoterminateunlesspromptnoticeisgiventotheUnderwritersandcontinuationofcoverisrequestedwhentheinsuranceshallremaininforce,subjecttoanadditionalpremiumifrequiredbytheUnderwriters,either
9.1untilthegoodsaresoldanddeliveredatsuchportorplace,orunlessotherwisespeciallyagreed,untiltheexpiryof60daysafterarrivalofthegoodsherebyinsuredatsuchportorplace,whichevershallfirstoccur,or
9.2ifthegoodsareforwardedwithinthesaidperiodof60days(oranyagreedextensionthereof)tothedestinationnamedhereinortoanyotherdestination,untilterminatedinaccordancewiththeprovisionsofClause8above.
9如果由于被保险人不能控制的情况，运输合同在保险单载明的目的地以外的港口或地点终止，或运送在上述第8条规定的交付货物前另行终止，那么本保险也终止，除非迅速地通知了保险人且在本保险仍有效时要求继续承保，并受保险人要求的附加保险费的制约：
9.1直至货物在此种港口或地点出售并交付，或除非另有特别约定，直至承保货物到达此种港口或地点满60天，二者以先性生者为准，或
9.2如果货物在上述60天（或任何约定的延展期间）内被运往保险单载明的目的地或其他目的地，直至根据上述第8条的规定而终止。
第10条航程变更条款(ChangeofVoyageClause)
10Where,afterattachmentofthisinsurance,thedestinationischangedbytheAssured,heldcoveredatapremiumandonconditionstobearrangedsubjecttopromptnoticebeinggiventotheUnderwriters.
10如果在本保险责任开始后，被保险人变更目的地，应按重新商定的保险费率和条件续保(heldcovered)，但以迅速通知了保险人为前提。
第11条保险利益条款(InsurableInterestClause)
1111.1InordertorecoverunderthisinsurancetheAssuredmusthaveaninsurableinterestinthesubject-matterinsuredatthetimeoftheloss.
11.2Subjectto11.1above,theAssuredshallbeentitledtorecoverforinsuredlossoccurringduringtheperiodcoveredbythisinsurance,notwithstandingthatthelossoccurredbeforethecontractofinsurancewasconcluded,unlesstheAssuredwereawareofthelossandtheUnderwriterswerenot.
11.1为了根据本保险索赔，在保险标的损失当时被保险人必须具有某种可保利益。
11.2根据上述11.1款，被保险人有权索赔在本保险承保期间发生的承保损失，尽管该灭失发生于本保险合同成立之前，除非被保险人已知悉该灭失，而保险人不知情。
第12条续运费用条款(ForwardingChargesClause)
12Where,asaresultoftheoperationofariskcoveredbythisinsurance,theinsuredtransitisterminatedataportorplaceotherthanthattowhichthesubject-matteriscoveredunderthisinsurance,theUnderwriterswillreimbursetheAssuredforanyextrachargesproperlyandreasonablyincurredinunloadingstoringandforwardingthesubject-mattertothedestinationtowhichitisinsuredhereunder.
ThisClause12,whichdoesnotapplytogeneralaverageorsalvagecharges,shallbesubjecttotheexclusionscontainedinClause4,5,6and7above,andshallnotincludechargesarisingfromthefaultnegligenceinsolvencyorfinancialdefaultoftheAssuredortheirservants.
12若由于本保险承保的风险的作用，导致承保的运输在保险标的根据本保险承保的目的地以外的港口或地点终止，保险人将补偿被保险人因卸下、贮存和续运保险标的至所承保的目的地而适当和合理发生的额外费用。
对共同海损和救助费用不适用的本条规定，须受上述第4、5、6和7条所包含的除外责任的制约，且不包括因被保险人或其雇员的过错、疏忽、无偿付能力或财务困境而引起的费用。
第13条推定全损条款(ConstructiveTotalLossClause)
13NoclaimforConstructiveTotalLossshallberecoverablehereunderunlessthesubject-matterinsuredisreasonablyabandonedeitheronaccountofitsactualtotallossappearingtobeunavoidableorbecausethecostofrecovering,reconditioningandforwardingthesubject-mattertothedestinationtowhichitisinsuredwouldexceeditsvalueonarrival.
13除非由于实际全损看来不可避免，或因为恢复、修复和续运保险标的至承保的目的地的费用，将超过其抵达时的价值，而合理地委付保险标的，推定全损索赔不能获得赔偿。
第14条增值条款(IncreasedValueClause)
1414.1IfanyIncreasedValueinsuranceiseffectedbytheAssuredonthecargoinsuredhereintheagreedvalueofthecargoshallbedeemedtobeincreasedtothetotalamountinsuredunderthisinsuranceandallIncreasedValueinsurancecoveringtheloss,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredhereinbearstosuchtotalamountinsured.
IntheeventofclaimtheAssuredshallprovidetheUnderwriterswithevidenceoftheamountsinsuredunderallotherinsurance.
14.2WherethisinsuranceisonIncreasedValuethefollowingclauseshallapply:
TheagreedvalueofthecargoshallbedeemedtobeequaltothetotalamountinsuredundertheprimaryinsuranceandallIncreasedValueinsurancecoveringthelossandeffectedonthecargobytheAssured,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredhereinbearstosuchtotalamountinsured.
IntheeventofclaimtheAssuredshallprovidetheUnderwriterswithevidenceoftheamountsinsuredunderallotherinsurance.
14.1如果被保险人对保险货物办理了增值保险，货物的约定价值应视为增加至本保险和承保灭失的所有增值保险的保险金额的总和，本保险项下的责任应按承保金额占此种保险金额的总和的比例计算。
倘若提出索赔，被保险人应向保险人提供所有其他保险的保险金额的证据。
14.2在本保险是增值保险的情况下，应适用下述条款：货物的约定价值应视为等于由被保险人对货物办理的原始保险和承保灭失的所有增值保险的保险金额的总和，本保险项下的责任应按承保金额占此种保险金额的总和的比例计算。
万一提出索赔，被保险人应向保险人提供所有其他保险的保险金额的证据。
第15条不生效条款（NottoInureClause）
15ThisInsuranceshallnotinuretothebenefitofthecarrierorotherbailee.
承运人或其他保管人不得主张本保险的利益。
第16条被保险人的义务条款(DutyoftheAssuredClause)
16ItisthedutyoftheAssuredandtheirservantsandagentsinrespectoflossrecoverablehereunder
16.1totakesuchmeasuresasmaybereasonableforthepurposeofavertingorminimisingsuchloss,and
16.2toensurethatallrightsagainstcarriers,baileesorotherthirdpartiesareproperlypreservedandexercised
16有关可索赔的损失，被保险人及其雇员和代理人有下述义务：
16.1采取为避免或尽量减少此种损失的全理措施，并
16.2确保对承运人、保管人或其他第三方追偿的所有权利被适当保留和行使。
第17条弃权条款(WaiverClause)
17MeasurestakenbytheAssuredortheUnderwriterswiththeobjectofsaving,protectingorrecoveringthesubject-matterinsuredshallnotbeconsideredasawaiveroracceptanceofabandonmentorotherwiseprejudicetherightsofeitherparty.
被保险人或保险人采取的旨在捞救、保护或恢复保险标的的措施不得视为放弃或接受委付或在其他方面损害任何一方的权利。
第18条合理速办(ReasonableDispatchClause)
18ItisaconditionofthisinsurancethattheAssuredshallactwithreasonabledespatchinallcircumstanceswithintheircontrol.
被保险人应在所有其控制的情况下合理迅速地行动是本保险的一项条件。
第19条英国法律与惯例条款（EnglishLawandPracticeClause）
19ThisinsuranceissubjecttoEnglishlawandpractice.
本保险受英国法律与惯例制约。
