ThisinsuranceissubjecttoEnglishlawandpractice.
本保险受英国法律和习惯制约。
第1条保障与赔偿条款
1PROTECTIONANDINDEMNITY
1.1TheUnderwritersagreetoindemnifytheAssuredforanysumorsumspaidbytheAssuredtoanyotherpersonorpersonsbyreasonoftheAssuredbecominglegallyliable,asowneroftheVessel,foranyclaim,demand,damagesand/orexpenses,wheresuchliabilityisinconsequenceofanyofthefollowingmattersorthingsandarisesfromanaccidentoroccurrenceduringtheperiodofthisinsurance.
1.1.1lossofordamagetoanyfixedormovableobjectorpropertyorotherthingofinterestwhatsoever,otherthantheVessel,arisingfromanycausewhatsoeverinsofarassuchlossordamageisnotcoveredbyClause8oftheInstituteTimeClauseHulls1/10/83with4/4thssubstitutedfor3/4thsinlinenos.80,81,98and99.
1.1.2Anyattemptedoractualraising,removalordestructionofanyfixedormovableobjectorpropertyorotherthing,includingthewreckoftheVessel,oranyneglectorfailuretoraise,removeordestroythesame.
1.1.3LiabilityassumedbytheAssuredundercontractsofcustomarytowageforthepurposeofenteringorleavingportormaneuveringwithintheportduringtheordinarycourseoftrading
1.1.4Lossoflife,personalinjury,illnessorpaymentsmadeforlifesalvage
1.1.5LiabilityunderClause1(a)ofthecurrentLloyd’sStandardFormofSalvageAgreementinrespectofunsuccessful,partiallysuccessful,oruncompletedservicesifandtotheextentthatthesalvor’sexpensesplustheincrementexceedanyamountotherwiserecoverableundertheAgreement.
1.2TheunderwritersagreetoindemnifytheAssuredforanyofthefollowingarisingfromanaccidentoroccurrenceduringtheperiodofthisinsurance:
1.2.1theadditionalcostoffuel,insurance,wages,stores,provisionsandportchargesreasonablyincurredsolelyforthepurposeoflandingfromtheVesselsickorinjuredpersonsorstowaways,refugees,orpersonssavedatsea
1.2.2additionalexpensesbroughtaboutbytheoutbreakofinfectiousdiseaseonboardtheVesselorashore.
1.2.3FinesimposedontheVessel,ontheAssured,oronanyMasterOfficercrewmemberoragentoftheVesselwhoisreimbursedbytheAssured,foranyactorneglectorbreachofanystatuteorregulationrelatingtotheoperationoftheVessel,providedthattheUnderwritersshallnotbeliabletoindemnifytheAssuredforanyfineswhichresultfromanyactneglectfailureordefaultoftheAssuredtheiragentsorservantsotherMasterOfficerorcrewmember
1.2.4theexpensesoftheremovalofthewreckoftheVesselfromanyplaceowned,leasedoroccupiedbytheAssured
1.1.5legalcostsincurredbytheAssured,orwhichtheAssuredmaybecompelledtopay,inavoiding,minimisingorcontestingliabilitywiththepriorwrittenconsentoftheUnderwriters.
1保障与赔偿
1.1由于被保险人作为船东对于任何索赔、要求、损害及/或费用负有法律责任，此种责任由于下述问题或事情引起，或发生于本保险期间，保险人同意赔偿被保险人因此而支付给任何其他人或人们的任何金额：
1.1.1除了保险船舶以外的任何固定或浮动物体或财产或其他无论何种物体的利益的灭失或损害，无论何因引起的，只要此种灭失或损害并非由1984年10月1日协会船舶定期保险条款第8条所承保的，即用四分之四取代规定于第80，81，98和99行的四分之三责任
1.1.2清除或销毁任何固定或可移动物体或财产或其他物体，包括船舶残骸的任何企图或实际发生者(actualraising)，或在清除或销毁上述物体时的任何过失或疏忽
1.1.3根据习惯拖带合同为了进出港口或在正常的运输期间在港内移动，被保险人应承担的责任
1.1.4人身伤亡、疾病或人命救助而支付的费用
1.1.5根据现行劳氏标准救助协议格式条款第1条(a)款，对有关不成功的，部分成功的或未完成的救助服务的责任，如果在救助人的费用加上增加的超出根据该协议可获赔偿的任何金额。
1.2保险人同意对本保险期间发生的任何下列偶然事故或偶然事件赔偿被保险人：
1.2.1纯属为了将病员、受伤人员或无票乘船者、避难者或在海上获救人员自船上运送到岸上而额外发生的燃料、保险、工资、给养和港口使费等费用
1.2.2由于船上或岸上爆发传染性疾病而产生的额外费用
1.2.3对于船舶、被保险人、或任何船长、高级船员、船员或由被保险人补偿的船舶代理人，因违反有关船舶营运的任何法规或规章或任何行为或过失而被课加的罚款
1.2.4自被保险人所有、租赁或占有任何地点清除船舶或残骸的费用
1.2.5经保险人事先书面同意为避免、减少或抗辩责任，被保险人所发生或被迫支付的法律费用。
EXCLUSIONS
除外条款
1.3NotwithstandingtheprovisionsofClauses1.1and1.2thisClause1doesnotcoveranyliabilitycostorexpensearisinginrespectthereof:
1.3尽管有1..1款和12款的规定，本第1条不承保因下述原因引起的任何责任费用或花费：
1.3.1anydirectorindirectpaymentbytheAssuredunderworkmen’scompensationoremployers’liabilityactsandanyotherstatutoryorcommonlaw,generalmaritimelaworotherliabilitywhatsoeverinrespectofaccidentstoorillnessofworkmenoranyotherpersonsemployedinanycapacitywhatsoeverbytheAssuredorothersinonoraboutorinconnectionwiththeVesselorhercargomaterialsorrepairs
1.3.2liabilityassumedbytheAssuredunderagreementexpressedorimpliedinrespectofdeathorillnessoforinjurytoanypersonsemployedunderacontractofserviceorapprenticeshipbytheotherpartytosuchagreement
1.3.1根据工人赔偿或雇员责任法或任何其他法规，普通法，一般海商法，对有关事故或工人或被保险人雇用的无论何种身份的人的疾病或与船舶、或船上货物或船舶修理有关的任何其他人员的其他责任，对被保险人直接或间接的赔偿
1.3.2根据明示或默示协议就有关根据服务合同或由他方对此种协议的学徒合同聘用的任何人员的伤亡或疾病，被保险人应负的责任
1.3.4cargoorotherpropertycarried,tobecarriedorwhichhasbeencarriedonboardtheVesselbutthisClause1.3.4shallnotexcludeanyclaiminrespectoftheextracostofremovingcargofromthewreckoftheVessel
1.3.4承运的，准备承运的，或已经装上船舶承运的，但不是本第1.3.4项的货物或其他财产，不应排除有关从船舶残骸移走货物的额外费用的任何索赔。
1.3.5property,ownedbybuildersorrepairersorforwhichtheyareresponsible,whichisonboardtheVessel
1.3.6liabilityarisingunderacontractorindemnityinrespectofcontainers,equipment,fuelorotherpropertyonboardtheVesselandwhichisownedorleasedbytheAssured
1.3.7cash,negotiableinstruments,preciousmetalsorstones,valuablesorobjectsofarareorpreciousnature,belongingtopersonsonboardtheVessel,ornon-essentialpersonaleffectsofanyMaster,Officerorcrewmember
1.3.5在船上的属于造船厂商或修理厂家所有或其负有责任的财产
1.3.6就有关被保险人所有的或租赁的装上船舶上的集装箱、设备、燃料或其他财产，根据一份合同产生的责任或赔偿
1.3.7属于船上任何人的或属船长、高级船员或船员的非基本的个人财产、现金、流通证券、贵重金属或宝石，有价的或罕有或珍贵性质的物体
1.3.8fuel,insurance,wages,stores,provisionsandportchargesarisingfromdelaytotheVesselwhileawaitingasubstituteforanyMaster,OfficerorCrewmember
1.3.8在等待替换的船长、高级船员或船员期间导致延误产生的燃料、保险、工资、给养、供应和港口使费
1.3.9finesorpenaltiesarisingfromoverloadingorillegalfishing
1.3.9由于超载或非法钓鱼引起的罚款或罚金
1.3.10pollutionorcontaminationofanyrealorpersonalpropertyorthingwhatsoever(ThisClause1.3.10shallnotexcludeanyamountrecoverableunderClause1.1.5)
1.3.10任何动产、不动产或无论何种物体的污染或沾染（本第1.3.10项不应排除根据第1.1.5项可获赔偿的任何金额）
1.3.11generalaverage,sueandlabourandsalvagecharges,salvage,and/ororcollisionliabilitytoanyextentthattheyarenotrecoverablebyreasonoftheagreedvalueand/ortheamountinsuredinrespectoftheVesselbeinginadequate
1.3.11共同海损、施救费用、救助及/或碰撞责任、因约定价值及/或在有关船舶不足额保险而不能获得赔偿的任何范围内。
1.3.12earthquakeorvolcaniceruption
1.3.12地震或火山爆发
1.4PROVIDEDALWAYSTHAT
1.4还应符合下列条件：
1.4.1promptnoticemustbegiventotheUnderwritersofeverycasualtyeventorclaimupontheAssuredwhichmaygiverisetoaclaimhereunderandofeveryeventormatterwhichmaycausetheAssuredtoincurliabilitycostsorexpensesforwhichhemaybeinsuredhereunder.
1.4.2theAssuredshallnotadmitliabilityfororsettleanyclaimforwhichhemaybeinsuredhereunderwithoutthepriorwrittenconsentoftheUnderwriters.
1.4.1每一事故、事件或对于可能导致依下述条款索赔的对被保险人提出的索赔，及引起被保险人发生责任，费用或开支且被保险人可依据本保险承保的每一事件或情况，均必须迅速通知保险人。
1.4.2未经保险人事先书面同意，被保险人不得承认依本保险受承保的责任或解决任何索赔.
2LIMITS
2.1WheretheAssuredortheUnderwritersmayorcouldhavelimitedtheirliabilitytheindemnityunderthisinsuranceinrespectofsuchliabilityshallnotexceedUnderwriters’proportionatepartoftheamountofsuchlimitation.
2限制
2.1若被保险人或保险人可以或本应已限制他们的责任，根据本保险对有关此种责任的补偿，不超过保险人对此种限制按比例分摊的金额。
2.2InnocaseshalltheUnderwriters’liabilityunderthisinsuranceexceedtheirproportionatepartoftheamountinsuredhereunderinrespectofeachseparateaccidentoroccurrenceorseriesofaccidentsarisingoutofthesameevent.
2.2在任何情况下，保险人根据本保险的责任，不超过有关就同一事件引起的每一独立的事故或事件或一系列事故，按比例分摊的保险金额。
3DEDUCTIBLE
3.1NotwithstandingtheprovisionsofClause1noclaimshallbepayableunderthisinsuranceunlesssuchclaim,ortheaggregateofallsuchclaimsarisingoutofeachseparateaccidentoroccurrence,exceedsinwhichcasethissumshallbededucted.
3.2Excludinganyinterestcomprisedtherein,recoveriesagainstanyclaimwhichissubjecttotheabovedeductibleshallbecreditedtotheUnderwritersinfulltotheextentofthesumbywhichtheaggregateoftheclaimunreducedbyanyrecoveriesexceedstheabovedeductible.
3.3InterestinrecoveriesshallbeapportionedbetweentheAssuredandtheUnderwriters,takingintoaccountthesumspaidbytheUnderwritersandthedateswhensuchpaymentsweremade,notwithstandingthatbytheadditionofinteresttheUnderwritersmayreceivealargersumthantheyhavepaid.
3免赔额
3.1尽管有第1条的规定，依据本保险不支付任何赔偿，除非此种索赔或由每一独立的事故或事件引起的所有此种索赔的累计金额超过在此种情况下应扣除该笔金额。
3.2不包括其中包含的任何利息，针对受上述免赔额制约的任何索赔的赔偿，在累计未经扣减的索赔金额范围内，对于超出上述免赔额的任何赔偿应贷计给保险人。
3.3获赔的利息应在被保险人和保险人之间进行分配，考虑到保险人赔付的金额和支付日期，尽管加上利息保险人可能收到大于其已赔付的金额。
4NAVIGATION
TheVesselhasleavetodockandundock,togointogravingdock,tosailornavigatewithorwithoutpilots,togoontrialtripsandtoassistandtowvesselsorcraftindistress,butitiswarrantedthattheVesselshallnotbetowed,exceptasiscustomaryorwheninneedofassistance,orundertaketowageorsalvageservicesunderacontractpreviouslyarrangedbytheAssuredand/orManagementand/orChartererswithoutthepriorwrittenagreementoftheUnderwriters.ThisClause4shallnotexcludecustomarytowageinconnectionwithloadinganddischarging.
4航海条款
保险船舶在所有时间根据本保险的各项规定承保，并许可在有或没有引航员的情况下开航或航行，试航及协助，拖带遇险船舶或驳船，但保证保险船舶不得被拖带，除非是习惯性的，或当需要协助时；事先未经保险人书面协议，也不得根据被保险人，船舶所有人，管理人和/或承租人事先安排的合同从事拖带或救助服务。但本第4条不排除与装卸有关的习惯拖带。
5TERMINATION
ThisClause5shallprevailnotwithstandinganyprovisionwhethertypedorprintedinthisinsuranceinconsistenttherewith.
UnlessUnderwritersagreetothecontraryinwriting,thisinsuranceshallterminateautomaticallyatthetimeof
5.1changeoftheClassificationSocietyoftheVessel,orchange,suspension,discontinuance,withdrawalorexpiryofherClasstherein.Howeverwheresuchchange,suspension,discontinuanceorwithdrawalofherClasshasresultedfromlossordamagecoveredbyClause6oftheInstituteTimeClauses-Hulls1/10/83orwhichwouldbecoveredbyaninsuranceoftheVesselsubjecttocurrentInstituteWarandStrikesClausesHulls-Timesuchautomaticterminationshallnotoperate
5.2anychange,voluntaryorotherwise,intheownershiporflag,transfertonewmanagement,orcharteronabareboatbasis,orrequisitionfortitleoruseoftheVessel.However,intheeventofrequisitionfortitleorusewithoutthepriorexecutionofawrittenagreementbytheAssured,suchautomaticterminationshalloccurfifteendaysaftersuchrequisitionwhethertheVesselisinportoratsea.
5终止条款
本保险的任何条款，不论是手写的，打印的还是印刷的，凡与本条不一致时，均以本条为准。
除非保险人书面另行同意，本保险在下列情况发生时自动终止：
5.1保险船舶的船级社变更，或其船级变更，暂停，中止，撤回或期满。不过，在此种船级社变更，暂停，中止，撤回是由于1983年10月1日协会船舶定期保险条款第6条承保的灭失或损害造成的情况下，或者是由于根据现行协会船舶战争险和罢工险定期保险条款承保的灭失或损害引起的，此种自动终止不生效。
5.2自愿或以其他方式变更船舶所有权或船旗、转给新的管理人，光船出租，或被征购，征用。不过，如果征购，征用未事先与被保险人签订书面协议，那么无论船舶是在海上还是在港内，此种自动终止将在船舶被征用后15天开始生效。
6BREACHOFWARRANTY
Heldcoveredincaseofanybreachofwarrantyastocargo,trade,locality,towage,salvageservicesordateofsailing,providednoticebegiventotheUnderwritersimmediatelyafterreceiptofadvicesandanyamendedtermsofcoverandanyadditionalpremiumrequiredbythembeagreed.
6违反保证
万一发生有关货物，贸易，船位，拖带，救助服务或开航日期违反保证的情形，假如在得知该等情况后立即通知了保险人，且双方同意保险人要求的承保条件的任何修改和任何附加的保险费，本保险继续有效。
7ASSIGNMENT
NoassignmentoforinterestinthisinsuranceorinanymoneyswhichmaybeorbecomepayablethereunderistobebindingonorrecognizedbytheUnderwritersunlessadatednoticeofsuchassignmentorinterestsignedbytheAssured,andbytheassignorincaseofsubsequentassignment,isendorsedonthePolicyandthePolicywithsuchendorsementisproducedbeforepaymentofanyclaimorreturnofpremiumthereunder.
7转让
本保险利益或依本保险得付或应付款项的转让，除非经被保险人，和在后续转让时经受让人，签署载有日期的此种转让通知批注在保险单上，并在支付赔偿或退还保险费前，将如此批注的保险单提交给保险人，不约束保险人，或为保险人承认。
8DUTYOFASSURED
ItisaconditionofthisinsurancethattheAssuredandtheirservantsandagentstakesuchmeasuresasmaybereasonableforthepurposeofavertingorminimisingalosswhichwouldberecoverableunderthisinsurance.
8被保险人的义务
被保险人和其雇员及其代理人采取合理措施，旨在避免或减少根据本保险应予赔偿的损失是本保险的一项条件。
9RETUTNSFORCANCELLATION
ToreturnproratamonthlynetforeachuncommencedmonthifthisinsurancebecancelledeitherbyagreementorbytheoperationofClause5providedthatatotallossoftheVessel,whetherbyinsuredperilsorotherwise,hasnotoccurredduringtheperiodofthisinsuranceoranyextensionthereof.
9解约时的退费
如果经协议或因第5条规定的假如船舶无论是因承保危险或其他原因导致全损，本保险被解除每一未开始的月份的净保险费按月比例退还。
10WAR,STRIKES,MALICIOUSACTSANDNUCLEARRISKSPARAMOUNTEXCLUSION
Innocaseshallthisinsurancecoverliabilitycostorexpensearisingasaresultoftheoperationofoneormoreofthefollowingperils:
10.1warcivilwarrevolutionrebellioninsurrection,orcivilstrifearisingtherefrom,oranyhostileactbyoragainstabelligerentpower
10.2captureseizurearrestrestraintordetainment(barratryandpiracyexcepted),andtheconsequencesthereoforanyattemptthereat
10.3derelictminestorpedoesbombsorotherderelictweaponsofwar
10.4strikers,locked-outworkmen,orpersonstakingpartinlabourdisturbances,riotsorcivilcommotions
10.5anyterroristoranypersonactingfromapoliticalmotive
10.6theuseofanyweaponofwar,orthedetonationofanexplosive,byanypersonactingmaliciouslyorfromapoliticalmotive
10.7anyweaponsofwaremployingatomicornuclearfissionand/orfusionorotherlikereactionorradioactiveforceormatter.
10战争、罢工、恶意行为及核危险首要条款
10.1战争、内战、革命、叛乱、暴动，或由此引起的内乱，或任何交战团体之间的敌对行动
10.2捕获、扣押、扣留、管制、拘押（船员欺诈恶行和海盗除外），及其引起的后果或任何威胁企图
10.3遗弃的水雷、鱼雷、炸弹或其他遗弃的战争武器
10.4罢工者、闭厂工人、或参与劳资纠纷、暴乱或民事骚乱的人
10.5任何恐怖分子或任何怀政治动机行事的人
10.6任何恶意行事的人或怀政治动机者，使用战争武器或引爆炸药
10.7使用原子或核裂变和/或聚变或其他类似反应或放射性物质的任何战争武器。
1991年6月1日协会保赔保险条款修正案
若任何下述条款被并入本保险，他们应视为已被删除：
1987年7月20日协会船舶港口险定期保险条款第9.1.5项；
1987年7月20日协会船舶港口险（包括限制航行）定期保险条款第10.1.5项；
1987年7月20日船舶定期保赔保险条款第1.1.5项；
1987年7月20日船舶定期保赔保险条款第1.1.5项当并入1987年7月20日协会船舶保赔保险战争和罢工定期保险条款。
并代之以下述：
依1980年劳氏标准格式救助协议第1条(a)款下的责任，有关未获成功，部分成功，或未完成的服务及在救助人的开支加上根据该救助协议超出其他可获赔偿的任何金额的增加量的范围内，以及根据1989年《国际救助公约》第14条，应支付特殊赔偿的责任，或根据并入1990年劳氏标准格式救助协议的该条款。
